Salvage
Historical wrecks
Permission to salvage wrecks that are protected by the Museum Law are only given in exceptional cases. The law covers all wrecks that sank more than 100 years ago, or wrecks that the Heritage Agency consider to have particular historical significance.
Salvaging is done at the salvor’s own expense and risk
Neither the Danish Maritime Safety Administration nor the Danish government accept responsibility for any damage related to the salvaging, whatever the nature of the damage may be. Injuries or damage incurred, for example, by ship, crew, equipment or a third party or a third party’s property is the salvor’s responsibility. Damage caused by salvage work or transportation to or from the salvage site, and any handling and detonation of ammunition, etc., is also the salvor’s own responsibility.
If the wreck or any part of it sinks, becomes stranded, lost or removed in connection with salvaging within Danish territory, the salvor is liable for all aspects of the state’s costs related to buoying, investigation and the necessary removal of wreckage or parts thereof, including ammunition.
The removal costs for any wreck remains, foreign objects from the salvaging, or anything else related to this permit, will be paid by the salvor, unless the salvor carries out the removal on the instructions of the Danish Maritime Safety Administration.
Depth impairment
When recording wrecks or wreck parts, the bed conditions must not be substantially altered, as it may lead to impairment of depth. Loose parts from the wreck should not be spread on the seabed, but must be recorded and removed from the seabed.
Buoying
The placement of any temporary buoys, etc., in connection with the salvaging can only be carried out with the approval of the Danish Maritime Safety Administration, and only in compliance with the conditions that the Danish Maritime Safety Administration demand.
Security
The Danish Maritime Safety Administration may require collateral in the form of a bank guarantee which would cover the amount that would be associated with the removal of the wreck, if the salvor were to lose it in a place where it could be a danger to navigation.
Transfer
A salvage permit is not transferable to others without the written agreement of the Danish Maritime Safety Administration.
